The TCPA prohibits the sending of unsolicited fax advertisements
unless the sender has the express prior consent of the recipient or
has an established business relationship with the recipient. All
commercial faxes, whether solicited or unsolicited, must contain a
toll-free opt-out number for recipients who do not wish to receive
future transmissions. Customers in violation of the TCPA may be sued
for actual damages or $500 per violation, whichever is greater.
Damages may be trebled if the violation is found to be willful or
knowing. Customers expressly warrant and represent that they comply
with these regulations and indemnify and hold harmless Slingshot,
its employees, shareholders and affiliates from any and all damages,
claims, causes of actions and liabilities arising from the
Customer’s use of Slingshot’s services.
NOTHING HEREIN SHALL BE CONSTRUED AS LEGAL ADVICE. CUSTOMERS ARE
URGED TO SEEK REPRESENTATION OF LEGAL COUNSEL FOR ALL ISSUES
RELATING TO THE TCPA OR ANY OTHER STATUTE OR REGULATION RELATING TO
TELECOMMUNICATIONS AND CONSUMER PROTECTION.
